The Texas Option Period: A San Antonio Buyer's Checklist
An accepted offer is an exciting milestone. It is also the beginning of a time-sensitive review. For a San Antonio resale purchase using the applicable TREC contract, the option period can give a buyer time to investigate the property and decide whether to proceed under the negotiated terms. Treat that time as a working schedule, not a pause.
Know which contract you signed
The TREC One to Four Family Residential Contract (Resale) is intended for eligible residential resales. Builder sales, condominiums, and farm-and-ranch purchases use different agreements. Read the actual signed documents with your agent and ask an attorney about legal interpretation. Do not assume a builder contract contains the same termination right.
Put the payment and termination deadlines on your calendar
Under paragraph 5 of the current TREC resale form, earnest money and the option fee are delivered to the escrow agent within three days after the effective date, with specified weekend and legal-holiday delivery extensions. The option length is negotiated. Option termination notice is due by 5 p.m. local time where the property is located on the applicable deadline. Delivery extensions and the option termination deadline are different rules.
The option fee generally is not refunded after a timely option termination; the form provides for refund of earnest money in that situation. A late or missing option fee can eliminate the unrestricted option termination right. Confirm the payment method, receipt, notice delivery, and deadline with your agent and escrow team. Your contract governs.
Use the first day to book the right inspections
Schedule promptly so there is time for specialist follow-up. A general inspection is a useful start, but a pool, septic system, well, substantial foundation concern, roof issue, or unusual electrical system may need a qualified specialist. For Hill Country properties, access and utilities deserve attention alongside the house. Ask each professional what is included and what is outside the inspection's scope.
Do not confuse a lender's appraisal with your inspection. They serve different purposes. An appraisal does not replace a close review of condition, operating costs, or repair needs.
Check the documents and the ongoing cost
Read the seller's disclosures and ask about unanswered items.
Review the survey, title commitment, recorded restrictions, and relevant HOA documents when available.
Request insurance quotes early, including any flood coverage questions.
Estimate taxes for your situation; the seller's exemptions may not reflect your future bill.
Confirm what conveys, including appliances, equipment, and transferable warranties.
Turn findings into a prioritized decision
Separate safety, major systems, and water intrusion concerns from routine maintenance and cosmetic preferences. Get realistic repair estimates when needed. A seller may agree to repairs, a credit, a price adjustment, or none of these. Any negotiated change should be documented in the appropriate written agreement before the relevant deadline.
Avoid letting every small defect distract from a significant issue. The practical question is whether the home, its condition, and the agreed terms still fit your budget and plans. Keep your lender informed about proposed credits or other changes because financing rules may affect how they can be used.
Plan for what happens afterward
If you proceed, keep following the financing, appraisal, title, and closing requirements. Expiration of the option period does not mean every later issue is resolved. If you need more investigation time, discuss a written extension before the current deadline; an extension is not automatic. If you decide to terminate, arrange the proper notice promptly rather than relying on an informal conversation.
A prepared buyer has a payment receipt, a deadline calendar, inspection reports, a documented decision, and a realistic plan for closing. Victor can help organize those moving pieces as you buy in San Antonio and the surrounding Hill Country.
